South Bend 2.16.01 St. Joseph County Prosecutor Chris Toth announced his support of HB 1138 and his intent to testify at Indianapolis hearings 2.20.01 scheduled for 10:30 a.m. The bill is a response to a 1.23.01 incident where a 10-year old student is accused of bringing a loaded handgun to his elementary School after taking it from a drawer in his home. H.B. 1138 would make it a Class A misdemeanor for an adult to, "store a loaded handgun, or one with ammunition nearby in a location where an unsupervised child would be able to get it with little difficulty." Penalities would be invoked if the child uses the gun to cause injury or is found in violation of existing state laws. Toth announced plans to revise the proposed law making it a Class D felony if children under 13 are involved. A Class D felony imposes a prison term of six months to three years and a maximum find of $10,000.
